Distance Selling Agreement

Preamble

This Distance Selling Agreement has been prepared in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts. This agreement regulates the rights and obligations of the parties in sales transactions conducted through the diantre.shop website.

Legal Basis: Article 48 of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

2. BUYER (CONSUMER) INFORMATION

The buyer is the natural or legal person who purchases products through the diantre.shop website. During ordering, information such as the buyer's name, surname, address, phone number, and email address is recorded and forms part of this contract.

Buyer's Obligations:

  • To provide accurate and up-to-date information when placing an order
  • To fulfill payment obligations
  • To ensure that the delivery address is correct and accessible

3. DEFINITIONS

  • Seller/Member Merchant: The business operating e-commerce activities under the Diantre brand, registered as a sole proprietorship in the name of Meriç Özkayagan.
  • Buyer/Consumer: The natural or legal person who purchases products through the website.
  • Contract: This distance selling agreement and its annexes.
  • Member Site: The diantre.shop website and all services offered on this site.
  • Product: All goods and services offered for sale on the website.
  • Order: The purchase request given by the buyer through the website.
  • Distance Contract: A contract concluded between parties who are not physically present in the same place, using remote communication tools.

4. SUBJECT OF THE AGREEMENT

This agreement regulates the sale, delivery, and after-sales services of products (clothing, accessories, and related products) offered for sale on the diantre.shop website.

Scope of the Agreement:

  • All sales transactions made through the website
  • Product delivery and shipping processes
  • Return and exchange procedures
  • Warranty and after-sales services

By placing an order, the buyer declares that they have read, understood, and accepted all terms and conditions set forth in this agreement.

5. PRODUCT INFORMATION AND PRICING

For each product offered for sale, the following information is clearly stated on the website:

  • Product name, brand, and model
  • Basic product features (size, color, material, etc.)
  • Unit price (including VAT)
  • Stock status
  • Discount rates, if any

Pricing:

  • All prices are displayed in Turkish Lira (TRY)
  • Prices include VAT
  • Shipping costs are not included in the product price and are stated separately
  • Prices may vary depending on stock status and campaigns

Payment Methods:

  • Credit card (Visa, Mastercard, Troy)
  • Debit card
  • Cash on delivery (cash or credit card)
  • Online payment systems (iyzico, etc.)

Installment: For payments made with credit cards, installment options approved by the bank may be offered.

6. ORDER PROCESS

  • Placing an Order: The buyer adds desired products to the cart and fills out the order form.
  • Order Confirmation: After placing an order, a confirmation email containing the order number and order details is sent to the buyer.
  • Formation of Contract: This distance selling agreement is deemed to be formed when the seller sends the order confirmation email.
  • Payment: Payment is made using the payment method selected during ordering.
  • Processing: After payment confirmation, the order is processed.

Order Cancellation:

  • The buyer may cancel their order before payment confirmation
  • After payment confirmation, withdrawal right provisions apply for order cancellation
  • Orders are not accepted for out-of-stock products or stock status is notified

7. DELIVERY TERMS

Order Processing Time:

Orders are processed and shipped within 1-3 business days after payment confirmation.

Delivery Methods:

  • Delivery by cargo (Yurtiçi Kargo, MNG Kargo, Sürat Kargo, etc.)
  • Delivery with cash on delivery option

Delivery Times:

  • Istanbul, Ankara, İzmir: 2-4 business days
  • Other provinces: 3-7 business days
  • Delivery times to villages and towns may be longer
  • Weather conditions, holidays, and extraordinary circumstances may affect delivery time

Delivery Costs:

  • Shipping costs are borne by the buyer
  • Shipping cost is determined based on order amount and delivery address
  • Free shipping campaigns may apply for orders above a certain amount
  • Additional fees may be charged for cash on delivery option

Delivery Address:

  • The buyer must provide a correct and up-to-date delivery address when ordering
  • Additional shipping costs arising from incorrect addresses are borne by the buyer
  • If the buyer or authorized person is not available during delivery, contact must be made with the cargo company

Risk and Transfer of Ownership:

  • The risk of loss and damage to products passes to the buyer when products are delivered to the cargo company
  • Ownership of products passes to the buyer when products are delivered to the buyer
  • If damage is detected in products during delivery, the buyer must prepare a report together with the cargo company

8. CONSUMER RIGHTS AND RIGHT OF WITHDRAWAL

Legal Basis: Pursuant to Article 15 of Law No. 6502 on the Protection of Consumers, the consumer has the right to withdraw from distance selling contracts.

Right of Withdrawal:

  • The buyer has the right to withdraw from this contract within 14 (fourteen) days from the date of receipt of the product, without giving any reason and without paying any penalty.
  • The withdrawal period begins from the day the goods physically come into the possession of the buyer or a third party (other than the carrier) indicated by the buyer.
  • The right of withdrawal cannot be used if the product is personalized or produced according to the buyer's request.

Exercise of Right of Withdrawal:

  • The buyer wishing to exercise the right of withdrawal must notify the seller by sending a notification to [email protected] or through the contact form on the website.
  • The withdrawal notification must clearly state the buyer's identity, order number, and withdrawal request.
  • The buyer may examine and try the product before sending the withdrawal notification, but should not use the product.

Return Procedures:

  • When the right of withdrawal is exercised, the buyer must return the product to the seller within 14 days.
  • Products to be returned must be unused, unworn, with tags attached, and in original packaging.
  • In case of use or damage that impairs the original condition of the product, the seller may request the amount arising from the loss of value of the product from the buyer.
  • Return shipping costs are borne by the buyer unless the product is defective or incorrect.

Refund Payment:

  • The seller is obliged to refund all payments received from the buyer (including delivery costs) within 14 (fourteen) days from the date of being informed of the withdrawal notification.
  • Refund payment is made using the same method the buyer used for payment.
  • For purchases made with cash on delivery, refund is made to the bank account.
  • Refund payment is made after the product is returned to the seller.

Situations Where Right of Withdrawal Cannot Be Used:

  • Products personalized or specially produced according to the buyer's request
  • Products that deteriorate quickly or have passed their expiration date
  • Products that cannot be returned for health or hygiene reasons after opening
  • Products that cannot be separated according to their material properties and combine with other goods after delivery

9. WARRANTY AND AFTER-SALES SERVICES

Legal Warranty:

  • Pursuant to Law No. 6502 on the Protection of Consumers, the seller is responsible for defective goods.
  • If a defect is detected in products, the buyer has the right to request defect-free goods, withdraw from defective goods, request correction of the defect, or request a price reduction.
  • Rights arising from defective goods can be exercised within 2 (two) years from the date of delivery of the product.

Commercial Warranty:

  • Commercial warranty periods and conditions specified by the manufacturer or seller apply.
  • Commercial warranty documents are delivered with the product or sent by email.

Defective or Damaged Products:

  • If a defective or damaged product is received, the buyer must immediately notify [email protected].
  • Defective products are replaced free of charge by the seller or a full refund is made.
  • Return shipping costs for defective products are borne by the seller.

  • Customer service is available on weekdays between 09:00-18:00.

10. PROTECTION OF PERSONAL DATA

In accordance with the Law on the Protection of Personal Data (KVKK):

  • The buyer's personal data is processed only to the extent necessary for the formation and performance of the contract.
  • Personal data is not shared with third parties, but may be shared with service providers such as cargo companies and payment processors.
  • The buyer may exercise their rights regarding the processing of personal data (access, correction, deletion, etc.).

11. FORCE MAJEURE

Circumstances beyond the control of the parties and unforeseeable (natural disasters, war, strikes, pandemics, government decisions, etc.) are considered force majeure.

In case of force majeure, parties cannot be held responsible for obligations arising from the contract and delivery times may be extended.

12. COMPLAINTS AND DISPUTE RESOLUTION

Complaints and Objections:

  • Complaints regarding orders, products, or services must be sent to [email protected].
  • Complaints are responded to within 15 (fifteen) days at the latest.

Dispute Resolution:

  • Disputes that may arise between parties are primarily attempted to be resolved through negotiations.
  • Pursuant to Law No. 6502, consumer disputes are resolved by Consumer Arbitration Committees and Consumer Courts.
  • The consumer may refer the dispute to the Consumer Arbitration Committee or Consumer Court.
  • Turkish Republic laws apply in the resolution of disputes.

Competent Court:

  • In the resolution of disputes, courts of the buyer's place of residence, seller's place of residence, or place where the contract is performed are competent.
  • Provisions in favor of the consumer are reserved.

13. GENERAL PROVISIONS

Validity of Contract:

  • The invalidity of any provision of this contract does not affect the validity of other provisions.
  • Instead of the invalid provision, the closest provision in accordance with the law applies.

Changes:

  • Changes to be made to this contract are effective from the date of publication on the website.
  • Existing orders are subject to the contract provisions in effect on the date the order was placed.

Notifications:

  • All notifications between parties are made via email or through the website.
  • The buyer's registered email address is the valid address for notifications.

Language:

  • This contract is prepared in Turkish and English.
  • In case of dispute, the Turkish text is taken as basis.

By reading this contract and placing an order, the buyer:

  • Declares and accepts that they have read and understood all provisions of the contract
  • Accepts the contract provisions
  • Consents to the processing of their personal data
  • Accepts that the contract is stored in electronic media
